These Terms & Conditions govern your use of the M. Zachi website and any purchases, orders or inquiries made through it.
The website and the M. Zachi brand are operated by Mor Projects, an Israeli Authorized Dealer No. 032649295, located at 5 HaUniversita St., Herzliya, Israel.
By using this website or placing an order, you agree to these Terms & Conditions.
1. ABOUT M. ZACHI
M. Zachi is an art brand offering original artworks, art prints, canvas prints, merchandise and commissioned/custom artworks.
Unless otherwise stated, all artwork, images, designs and creative content appearing on the website belong to M. Zachi.
2. WEBSITE USE
The website may be used only for lawful and personal purposes.
You may not use the website in a way that is illegal, damaging, unauthorized, fraudulent or infringes the rights of M. Zachi or any third party.
We may modify, update, suspend or discontinue parts of the website where reasonably necessary.
3. PRODUCTS
We make reasonable efforts to display products, artwork, colors, materials and dimensions accurately.
However, colors and appearance may vary slightly depending on screen settings, lighting, printing processes and materials.
Minor differences between an image displayed on a screen and the physical artwork or product do not necessarily constitute a defect.
Relevant dimensions, materials and other product information will be provided on the applicable product page where available.
4. ORIGINAL ARTWORKS
Original artworks may not be available for direct purchase through the website checkout.
Submitting an inquiry regarding an original artwork does not create a binding transaction or automatically reserve the artwork.
Availability, price, payment arrangements, shipping and other relevant details may be agreed directly with the customer.
An artwork will be considered reserved or sold only following explicit confirmation and any agreed payment arrangements.
5. PRINTS
M. Zachi may offer reproductions of original artwork as paper prints or canvas prints.
Unless a product is specifically described as a Limited Edition, prints offered through the website are open editions, and no maximum number of copies is promised or implied.
Print sizes, materials and production methods may vary between products.
A print is a reproduction and is not an original hand-painted artwork unless expressly stated otherwise.
6. MERCHANDISE
M. Zachi may offer merchandise featuring artwork, designs or branding.
Product specifications, materials, sizing and availability may vary.
Where products are manufactured or fulfilled by third-party providers, minor production variations may occur.
7. COMMISSIONED AND CUSTOM ARTWORK
Commissioned or customized artwork may be agreed directly with the customer.
Details including price, dimensions, concept, schedule, payment arrangements and shipping may be agreed individually.
Cancellation rights relating to products made according to special measurements or requirements may differ under applicable Israeli law.
Commissioning an artwork does not transfer copyright or commercial reproduction rights unless expressly agreed in writing.
8. PRICES AND PAYMENT
Prices are displayed in the currency shown on the website.
The final price applicable to an online purchase will be presented before completion of checkout, including applicable shipping charges or other amounts where required.
Prices may change from time to time, but a later price change will not affect an order already accepted.
Orders may be subject to successful payment authorization.
Where an obvious pricing or technical error occurs, we may correct the error and, where permitted by law, cancel the affected transaction and refund amounts already paid.
9. SHIPPING WITHIN ISRAEL
Standard shipping within Israel is currently free unless otherwise clearly stated before purchase.
Delivery times may vary depending on the product, production requirements and destination.
Any delivery time communicated by M. Zachi is an estimate unless expressly stated otherwise.
We will make reasonable efforts to prepare and deliver orders within the estimated period.
10. INTERNATIONAL SHIPPING
International shipping may be available to selected destinations.
Shipping charges may depend on destination, product size, weight, packaging requirements and shipping method.
Where required, the applicable shipping cost will be displayed or communicated before the transaction is finalized.
Unless expressly stated otherwise, customers are responsible for customs duties, import taxes, local VAT, handling charges or other fees imposed by authorities in the destination country.
International delivery times are estimates and may be affected by customs, postal services, couriers or circumstances outside our reasonable control.
11. ORDER CONFIRMATION AND AVAILABILITY
An automated order confirmation acknowledges that an order has been received.
In rare cases, availability, production, payment or technical issues may be discovered after an order is submitted.
If we are unable to fulfill an order after payment has been received, we will notify the customer and provide the appropriate refund in accordance with applicable law.
12. CANCELLATION AND RETURNS
Cancellation and return rights are governed by applicable law, including the Israeli Consumer Protection Law, 5741–1981 and applicable regulations.
In eligible distance-sale transactions, consumers may have a statutory right to cancel the transaction within the period and under the conditions provided by law.
For an ordinary eligible cancellation that is not due to a defect, non-conformity or failure to supply the product as required, a cancellation fee of up to 5% of the transaction price or NIS 100, whichever is lower, may apply to the extent permitted by law.
Where cancellation results from a defect, non-conformity or failure to supply the product as required, no cancellation fee will be charged where prohibited by law.
Return responsibility and arrangements will be handled in accordance with applicable law and the instructions provided to the customer.
Nothing in these Terms limits any mandatory consumer right that cannot legally be waived or restricted.
13. CUSTOMIZED PRODUCTS
Different cancellation rules may apply to products or artworks made specifically for a customer according to special measurements or requirements.
Any restriction on cancellation will apply only to the extent permitted by applicable law.
Customers wishing to cancel a customized order should contact us as soon as possible, particularly before production has begun.
14. HOW TO CANCEL AN ELIGIBLE TRANSACTION
Where a customer has a statutory right to cancel a transaction, a cancellation request may be submitted using the methods available under applicable law, including the designated online cancellation method provided through the website.

15. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

16. INTELLECTUAL PROPERTY AND COPYRIGHT
All artwork, illustrations, photographs, designs, graphics, logos, text, branding and other creative material appearing on the website are protected by applicable intellectual property laws.
Unless expressly stated otherwise, copyright and other intellectual property rights remain with M. Zachi or their lawful owners.
Purchasing an original artwork, print or merchandise item does not transfer copyright.
The buyer acquires ownership of the physical product only.
Without prior written permission, artwork or other protected content may not be reproduced, copied, scanned, printed, published, distributed, licensed, modified, commercially exploited or used to create merchandise or derivative products.
M. Zachi artwork may not be used for commercial advertising, merchandise, digital products, NFTs or other commercial reproduction without written authorization.
17. IMAGES AND SOCIAL MEDIA
Customers may photograph artwork or products they own and share those photographs for personal and non-commercial purposes.
Such sharing does not grant any right to reproduce or commercially exploit the artwork itself.
Attribution to M. Zachi is appreciated when artwork is shared publicly.
18. THIRD-PARTY SERVICES
The website may use third-party providers for services including payment processing, hosting, shipping, analytics, production and fulfillment.
Those providers may operate according to their own terms and privacy policies.
M. Zachi is not responsible for independent third-party services beyond any responsibility that cannot lawfully be excluded.
19. WEBSITE AVAILABILITY
We do not guarantee that the website will always operate without interruption or error.
Access may occasionally be affected by maintenance, technical problems, security issues or third-party services.
20. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, M. Zachi and Mor Projects will not be liable for indirect, incidental or consequential losses arising solely from the use or inability to use the website.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
Nothing in this section limits mandatory consumer rights.
21. FORCE MAJEURE
M. Zachi will not be responsible for delays or failure to perform obligations caused by circumstances beyond reasonable control.
These may include war, hostilities, natural disasters, fire, strikes, governmental restrictions, transportation disruptions, postal or courier interruptions, internet failures or infrastructure disruptions.
Where such circumstances materially affect an order, we will make reasonable efforts to communicate with the customer and provide an appropriate solution.
22. PRIVACY
Personal information is handled in accordance with applicable privacy law and the M. Zachi Privacy Policy.
These Terms should be read together with the Privacy Policy available on the website.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to the website, products, business operations or applicable law.
The current version will be published on the website with its revision date.
A transaction already completed will generally remain subject to the terms applicable at the time of that transaction, subject to mandatory law.
24. GOVERNING LAW
These Terms are governed by the laws of the State of Israel.
Any dispute will be subject to the competent courts in Israel in accordance with applicable jurisdiction rules.
Nothing in this section removes any mandatory consumer protection or jurisdiction right provided by applicable law.
